These terms explain how we work together when you order a portrait from Barksmith Studio, a store operated by Che, MB, registered at Juknaičių g. 29, Slengių k., LT-92343 Klaipėdos r., Lithuania, company registration number 307744104. If anything here is unclear, please write to us at [email protected] before you order — we would much rather answer a question than sort out a misunderstanding later.

By placing an order, you agree to what follows. If you do not agree, please do not place an order. You can still use the free preview without buying anything.

1. Who we are and how to reach us

Barksmith Studio is a trading name of Che, MB. Our postal address is Juknaičių g. 29, Slengių k., LT-92343 Klaipėdos r., Lithuania. The fastest way to reach a real person is [email protected]. We aim to answer every message within one business day.

2. The free preview

You can upload a photo and see a portrait preview without creating an account and without paying anything. Nothing is charged, and nothing is printed, until you place an order and complete payment. A preview is exactly that — a preview. The finished printed piece is produced at full resolution by our studio and may differ slightly in crop, tone and detail from what you saw on screen. Screens also vary: colours on your phone will not match a printed canvas perfectly.

3. Orders and acceptance

When you complete checkout you are making an offer to buy. Your order is accepted only when we send you an order confirmation by email. Until then, no contract exists between us.

We may decline or cancel an order — and refund you in full — if the item is unavailable, if there is an obvious pricing or description error, if we cannot produce an acceptable portrait from the photo supplied, if we suspect fraud, or if the uploaded photo breaks the rules in section 6. If we cancel after you have paid, you get your money back in full.

Because every piece is made to order, we begin production shortly after your order is confirmed. If you need to change or cancel an order, write to [email protected] as soon as you can and we will do our best if production has not started. Once a piece is in production it cannot be cancelled, but our guarantee in the Refunds & Returns policy still protects you.

4. Prices, taxes and payment

Prices are shown in US dollars and include the item and, where stated, free shipping within the USA. Sales tax is added where we are required to collect it, and is shown at checkout before you pay.

Payment is taken at checkout through our payment processor. We do not see or store your full card details. Promotional prices and sale discounts apply only while the offer is running and cannot be applied to an order placed before or after it. If a price is clearly wrong — a typo, a decimal in the wrong place — we will contact you before doing anything, and you can confirm at the correct price or take a full refund.

5. Your photo: what you promise us

You keep ownership of the photo you upload. Nothing here changes that.

By uploading a photo, you confirm that you either took it yourself or otherwise have the right to use it and to let us use it for your order, and that everyone recognisable in it — people as well as pets — is happy for it to be used this way. If the photo was taken by a professional photographer, please check your agreement with them first; many photographers keep the copyright even after you have paid for the pictures.

You are responsible for the photo you upload. If a claim is brought against us because a photo you supplied infringed someone else's rights, you agree to cover the reasonable costs and damages that result, to the extent the law allows.

6. The licence you give us

So that we can actually make your portrait, you grant us a limited, worldwide, royalty-free licence to store your photo, work with it in our studio, and pass it to the service providers who help us fulfil the order — principally our print partner. This licence exists only to fulfil your order and support you afterwards (for example, to reprint a damaged item), and it ends when we delete the photo.

We will not use your photo or your finished portrait in advertising, on our website, or on social media unless you give us separate, specific permission. If you would like to be featured, we are always glad to hear from you — but we will always ask first.

7. Acceptable use

Please do not upload anything unlawful, hateful, sexual, violent, or that infringes someone else's copyright, trademark or privacy. Please do not upload photos of children other than your own family, or photos of identifiable people who have not agreed to it. Please do not try to interfere with, overload, scrape or reverse-engineer the site.

We may refuse or cancel any order and remove any upload that breaks these rules, and we may report unlawful material to the authorities.

8. Rights in the finished artwork

The portrait we make for you is yours to keep, hang, photograph and share with friends and family, and to give as a gift. What you may not do is resell it commercially, mass-produce it, or use it as branding for a business, without our written agreement.

Our designs, scene templates, our artists' process, the site itself, our text, photographs, logos and layout remain our property. Buying a portrait does not transfer any of that to you.

9. Delivery and risk

Production and delivery times are set out in our Shipping policy. Estimates are estimates, not guarantees — carriers occasionally run late, and weather and holidays affect them. Risk in the item passes to you when it is delivered to the address you gave us. Please double-check that address at checkout; see the Shipping policy for what happens if it is wrong.

10. Our guarantee, and what we do not promise

We stand behind our work: see the Refunds & Returns policy for the 30-day happiness guarantee and free repaints. Beyond that guarantee and the rights the law gives you, we provide the site and our products as they are, without further warranties. We do not promise that the site will always be available or free of errors.

11. Limitation of liability

Nothing in these terms limits liability that cannot legally be limited — including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the fullest extent the law allows, our total liability to you in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, lost profits, lost data, or loss of the original photo where you have not kept a copy of it. Please keep your own copy of any photo that matters to you.

12. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published when you placed it. The date at the top shows when this version was issued.

13. Governing law

These terms are governed by the laws of the Republic of Lithuania, and the courts of the courts of the Republic of Lithuania have jurisdiction over any dispute. This does not take away any right you have to bring a claim in the courts of the place where you live, where the law gives you that right.

14. General

If any part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce something straight away, we have not given up the right to enforce it later. These terms, together with our Privacy Policy, Refunds & Returns policy and Shipping policy, are the whole agreement between us about your order.
